I struck a match and looked out of the window. I saw the place was on fire, and dressed as quickly as possible.

I had roused up my brother, and we both ran downstairs. Previously, while dressing, I was sing, ing out Fire and Mr MeU came to my door to alarm us. Amongst, other witnesses, James Miller Brown, brother of the previous witness, gave evidence that he was in his brother's room on the night of the fire, and was aroused with him. Constable William Lee stated that he was on duty in the Octagon on tho night of the fire, and frequently visited the cafe" during the night at a quarter-past eleven p.m, half -past twelve a.m. and ten mlnites past one a.m. On each occasion found everything quite safe. Between fifteen and twenty minutes past two he noticed a flame shining on the new town hall, and saw the fire proceeding from the direction of the cafe.

The flames appeared to be more in the back port of building than in the front. I first observed the light when I got to Peterson's corner coming south, and when I got to the footpath at the corner I saw that tho light had been removed into another room It bad dissDDcared. I don't think it been blown out it disappeared gradually, not suddenly.

It was rather a dim light, probably that of a candle. When I first noticed it the light was near the window, and then it grew fainter 'and fainter till it dinappeared altogether. About eight or ton minutes afterwards I noticed that a fire had broken out on the premises. The body of fire was in the room where I bad seen the light whilst passing throueh the Octairon. Of that I am ouite cer tain.

The front of the caf5 was not very much burnt at this time the flames appeared to be more nt the roof of the cafe. 1 have been in the habit of going through the Octagon at such hours for the past eight or nine months, and I have never beforo seen a light in the cafe at such a late hour. 7 Alfred Hall, a young man, said I am a singer with the Lingard Company, and live at the aSitanish Restaurant. I first knew Waters about two years ago in Melbourne, through his brother, Charles Woodlock, who was a dairyman in CoUiugwobd. I came over to Dunedin about fifteen months ago.

About four months ago I met He told me that he had had a row with his brother, and that he was going into the restaurant business here. 1 accompanied him, and we looked at two or three places. lie ultimately decided to take the place which was recently burned down. Ho often told mo about the barney he had had with his brother, and tho way in which he said his brother had tried to put him in gaol over a watch, chain and rin. Waters also told me that as his wife and ho could not agree, he went to Sydney, but ivftcr-wards returned to Melbourne, when he tried to prosecute his brother for perjury.

I came to live with him a fortnight after he entered this house." I have frequently heard him say. In talking about fires and so forth, that it was quite easy to put a match to anything, and all that. I havo alfio heard him sav that he would not do it without first being insured. This is since ho came hore. He said it in the presence of Mrs.

Woodlock who is called Mrs. Waters here and she. told him to be careful as to what he said. I met him out in-the street ono day I suppose about a week after he said these 'thingB and be told me he had had. a devil of a job to get his things ins surod, and that be had been running all over the place.

I went to live with him Rome time after this. Then he said ho believed that the bank managers must hold communication with the insurance company. Ho thought tho reason they did this was becauso if a man had no funds in the bank they would not insure him. He said he had put 100 in the bank the day before, and then he had about half a dozen men there watting to insure the place. I think I stayed with Air.

Waters for a fortnight or three weeks aftestthat I left about 2Sth July. I often used to go in now and again afterwards to get a meal or anything like thnt. One night, about three weeks afterwards, I went to get a bed. He was dancing on the stage, being accompanied by a pianiut, Mrs. Waters was in the room, and ho turned round to her and said.

"There's a friend of Yours." I walked up to tho middle of the room, and alter had stood tnere a minute Mrs. Waters turned round all of a sudden and told me she would be much obliged to me if I would go away ana not come near me place any more. I told her to hold her tongue, as her master was there. She thereupon threatened to give me a dig under the earhole and chuck me out without another word. With that I walked out, and have never spoken to him since, though I have seen him several times.

The coroner you attach much importance to what Waters said Do you think that a man who was going to sot fire to his place would go and tell people about it Witness I cannot say anything about that. The coroner Did you believe he was in earnest, or only in fun Witness I took it in earnest because I thought he was capable of doing it. I thought in my own mind that a man who would go away witn nts nrotner wijo and child would be capable of doing 'anything, especially after saying it. Also his brother told me that he had been convicted before, and was in Pentridtro. Besides the names of Woodlock and Waters, I have heard it said that he was once known as Walter Clare.

The foreman Do yon ask the jury to believe that you thought he was capable of setting fire to the place when you slept there In the top story I did not think anything about that. I knew there was another entrauce out, and it was possible that ho might not havo been in earnest. The foreman: Havo you any Ill-feeling against Mr. Waters now Not the slightest. Isidore Isaacs gave evidence that Waters seemed very anxious to have the place insured.

George Ritchie said I was lately a steward at Mr. Waters' been there about two months. I was in the house when the fire occurred. Mr. Waters aroused me.

The place was in flames. I heard him call out For God's sake, Jane (meaning Mrs. Waters), come away, the place is on fire 1" Mrs. Waters was then in her bedroom. I tried to get upstaiaa to waken tho people, but could not on account of the smoke and flame.

Mr. Waters was in his shirt when he woke me. I used to trim the three kerosene lamps in the I trimmed them oa Saturday about four o'clock. The kerosene was procured at Peterson's, who told me that a gallon-tin case would bo the best to get After trimming the lamps on Saturday the tin was quite half full 1 now I find that It does not contain more than half a gill. No one had aright to touch the kerosene but myself.

A parcel of half-burned rags wat here produced. The coroner 1 What are those? I have no smell. The coroner 1 Can't you smell at all No. The coroner You oould not tell whether they are soaked in anything No, I could not but I feel them wet, The coroner 1 Where were these dresses kept Thy were bung upon the wall. Thepwere clear of all lampsand all danger. They were on the wall opposite the door.

They would be three or four feet from the stage lamp. There was no ehanoe of these clothes getting soaked in the kerosene. Since the fire Mr. Waters has no-cased me of having been drank on the Sunday, aad ef having spilt kerosene on the rug before the fire In the reading-room. He first accused ma of this last Tuesday, and he spoke to me mn about it to day.

I don't think the water could have got to them. They were lying within tw feet of the fireplace of the reading-room, and close to the wooden partition. About ten o'clock on Monday morning I saw this kerosene tin standing on the lower floor of the building, under tbe stairway leading from the readingroom to Mr. Waten's private bedchamber. The tin then was in the same condition as It Is now, having, the same quantity of oil ia There are no signs of fire about the tin.

William Charles Kennedy, agent of the Hanseatio Insurance Company of Hamburg, proved that Mr. Waters insured his stock on the 9th of July for 600. He had been sent to me by Mr. Campbell, of the Norwich Union, who had declined to insure to an amount of 500 or 600, 1 am not quite sure which, as the buildings were already insured with the company. Mr.

Campbell advised me not to give a policy for more than 300 to 350. Mr. Waters wanted an insurance of more than 350 on the first occasion. Inspector Mallard gave evidence of the dis. orderly manner in which the cafe was carried on, and that on the Saturday night before the fire he warned Waters that the place would have to be closed.

Keading from the Police Gazette: "Walter Clark, Melbourne, tried on the 6th March-1871, burglary and stealing, for four years and three years accumulative. Nativo of Melbourne, born 1848, height five feet six inches, brown hair, grey eyes, medium chin." There is another reference On the June tbe same man, under tbe name of Walter Clark, was sentenced to one year for stealing from the person.

He is described in exactly the same way, with a mark upon him precisely the same as one which Mr. Waters bears. The officer in charge of this division has telegraphed to the Chief Comitsioner of Police in Victoria for further particulars; but I to say that the two men seem to me to be identical. I may mention that I have here a return which may be of some use. It shows that six persons escaped by ropes, eleven by the west end of the stairs, three by the east, eight by the basement door, two from the windows, two by the ladder, and one dropped from theparapet making a total of thirty-three.

On the ltith September Waters was brought up at the police court and remanded till 2'ind September. A difficulty therefore arose relative to his attendance at the coronial inquiry, which was adjourned tilt 1 7th September, to allow communication with the Attorney-General, the gaoler refusing to give np the prisoner without a writ of habeat.

On 17th September Waters, who was defended by Mr. J. E. Denniston, attended. We havo since heard by telegraph that, upon the verdict of tho jury, Waters has been committed fur trial on a charge of incendiarism and wilful murder.

A public funeral to tho victims of the fire was given on Saturday, 13th September. Four hearties were provided, and the following bodice were placed In them for burial Robert Wijson, fifty-nine years Sarah Wilson, thirty-nine years Frederick Wilson, eighteen years Kobert Wilson, ten years Sarah Wilson, nine years Lawrence Oliphant Wilson, four years John W. Swan two bodies unknown. All the shops were closed, and the fire bell gave the funeral toll aa the city was packed through. Immense numbers of people thronged the streets to witness the last sad scene in connection with tho deplorable accident.

On Sunday, 14th September, the funerals of John Taylor and Margaret M'Cartuey, two victims of the fire, took place.
